STANDARD TERMS & CONDITIONS
Clinipower Limited (“the Operator”) accepts Waste in the following forms at its Avonmouth facility.
- Clinical Waste destined for treatment through Autoclaves (Orange bags)
EWC Codes 18 01 03*, 18 01 04, 18 02 02* and 18 02 03 shall be accepted. No human or animal tissue, blood or pharmaceutical
products shall be present.
- Clinical Waste destined for high temperature destruction (Pyrolysis & Gasification).
EWC Codes 18 01 01, 18 02 01, 18 01 02, 18 01 03* 18 01 04, 18 01 06*, 18 01 07, 18 01 08*, 18 01 09, 18 02 01, 18 02 05*, 18 02
06, 18 02 07* 18 02 08. Waste may be multiple coded i.e 18 01 03*/ 09.
- Wastes of other categories are contained within the operating Licences. Please contact CliniPower’s Operations Manager for
consent prior to delivery.
- The Operator does not accept Low Level Radioactive Waste.
If the Client presents waste for treatment or destruction, which is not described by the correct European Waste Code (EWC) or the consigned
waste contains substances not suitable for disposal by the requested method, then the Operator reserves the right to reject the consignment or
transfer it to a suitable treatment at the appropriate cost.
The Operator reserves the right to render invoices at such intervals and in respect of such quantities of waste delivered, as it shall think fit. All
invoices for waste disposal shall be linked to appropriate delivery notes.
Invoices are payable on receipt of the invoice.
All payments must be made without deduction and the Customer shall not be entitled to set off against any payment due under this contract any
sum to which it may be entitled under any other contract.
Delivery of Waste
The Customer shall be responsible for the unloading of all waste delivered to the Operator’s premises, which shall be carried out in accordance
with the Operators instructions and requirements from time to time.
All relevant paperwork relating to each delivery of waste including consignment note and Hazardous Waste Consignment Notes shall be the
responsibility of the Customer. No waste will be accepted without the correct paperwork.
The Operator shall use all reasonable endeavours to achieve the turn round of vehicles in the shortest possible time but will not be held liable
for any waiting time or delay, which may occur in offloading the Customer’s waste. The Customer and any persons authorised by it entering
upon the Operator’s premises do so at their own risk and the Operator accepts no liability for the death or injury of any person or damage to
property suffered as a result of such entry except to the extent that it is the direct result of negligence by the Operator.
Suspension of Service
The Operator reserves the right to suspend or terminate its services under this Contract or extend the time for performance of its obligations
hereunder without payment of compensation to the Customer if for any reason beyond its control it shall be unable to fulfil its obligations under
Termination of Contract
The Operator shall be entitled to determine or suspend the Contract at any time if the Customer shall fail to pay sums payable hereunder, shall
commit an act of bankruptcy, or shall otherwise fail to duly perform its obligations hereunder or fail to comply with any relevant statutory
requirements. Such determination or suspension shall be without prejudice to the Operator’s rights in respect of any sums due from the
Customer or any breach by the Customer of the terms of this Contract occurring before the date of determination or suspension.
Status of these Conditions
In the event of any conflict between these conditions, or the conditions attached to the Operators IPPC, and the conditions of any Customer,
these conditions or the conditions of the Local Authority Licence and the Waste Incineration Directive (as the case may be) shall prevail.
The Operator shall at its discretion be entitled to render invoices in respect of part only of the service and/or render invoices in respect of such
periods of time, as it considers appropriate.
